Eeshas.com is operated by Eeshas Creations LLC., referred to in these Terms and Conditions as “Eeshas.com,” “Eeshas,” “we,” “us” or “our.” The terms “you,” “your” and “customer” refer to any person who visits our website, creates an account, submits information or purchases products from us.

Please read these Terms and Conditions carefully. By visiting Eeshas.com, creating an account, placing an order or otherwise using our website or services, you acknowledge that you have read, understood and agreed to these Terms and Conditions and all policies referenced in them.

If you do not agree to these Terms and Conditions, you must not use our website or purchase products through it.

1. Eligibility and Online Store Use

You must be at least the age of majority in your state, province or country of residence to make a purchase from Eeshas.com. A parent or legal guardian may allow a minor dependent to browse or use the website under the parent’s or guardian’s supervision.

You agree to use Eeshas.com only for lawful purposes. You may not use our website, products or services:

  • In violation of any applicable federal, state, local or international law;

  • To infringe the intellectual-property, privacy or other legal rights of another person;

  • To transmit viruses, malware or other harmful computer code;

  • To gain unauthorized access to our website, customer accounts or related systems;

  • To engage in fraudulent activity; or

  • To interfere with the security or operation of our website.

We may suspend or terminate access to our website when we reasonably believe that a user has violated these Terms and Conditions or engaged in fraudulent, abusive or unlawful activity.

2. Product Information

Eeshas.com offers sarees, garments, accessories and related products. We make reasonable efforts to provide accurate product descriptions, photographs, measurements, colors, materials, prices and availability information.

However, you understand and agree that:

  • Colors may appear differently depending on lighting, photography, screen settings and the device used to view the product;

  • Handwoven, handloom, hand-dyed, embroidered or handcrafted products may contain minor variations in color, weave, texture, thread work, zari, motifs or finishing;

  • Traditional weaving characteristics, minor thread irregularities, slubs or variations that arise naturally from handcrafted production may not be considered defects;

  • Product measurements are approximate and may vary slightly;

  • Saree falls, edging, tassels, blouse pieces, petticoats, accessories, jewelry or other displayed items are included only when expressly stated in the product description;

  • Model photographs are for presentation purposes, and the appearance, drape or fit of a product may vary by individual; and

  • Product availability and specifications may change without notice.

You are responsible for reviewing the complete product description, dimensions, fabric information, care instructions and included components before placing an order.

3. Pricing, Taxes and Charges

All prices are displayed in the currency stated on the website, generally U.S. dollars unless otherwise indicated.

Product prices may change without notice. A price change will not affect an order that we have already accepted, except when a displayed price resulted from an obvious technical, typographical or system error.

Applicable sales taxes, shipping charges, handling charges, international duties or other fees will be displayed at checkout when reasonably possible.

For international orders, customs duties, import taxes, brokerage charges and similar government fees may be imposed by the destination country. Unless expressly stated otherwise, these charges are the customer’s responsibility and are not included in the product price or shipping charge.

4. Orders and Order Acceptance

Submitting an order does not automatically mean that we have accepted it. Your order is an offer to purchase the selected products subject to these Terms and Conditions.

We may accept, reject, limit or cancel an order for reasons including:

  • Product unavailability;

  • Incorrect product, pricing or inventory information;

  • Suspected fraud or unauthorized payment activity;

  • Payment authorization failure;

  • Shipping restrictions;

  • Errors in the customer’s billing or shipping information;

  • Orders that appear to be intended for unauthorized resale; or

  • Circumstances outside our reasonable control.

An automated order-confirmation email acknowledges that we received your order. It does not necessarily constitute final acceptance. An order is generally accepted when payment is approved and the order enters processing or is shipped.

If we cancel an order after receiving payment, we will issue an appropriate refund to the original payment method, subject to the processing times of your bank or payment provider.

5. Billing and Account Information

You agree to provide accurate, complete and current information for all transactions, including your name, email address, telephone number, billing address, shipping address and payment information.

You are responsible for confirming the accuracy of your shipping address before submitting an order. Eeshas.com is not responsible for delays, returned packages or delivery failures caused by an incorrect or incomplete address provided by the customer.

When you create an account, you are responsible for:

  • Maintaining the confidentiality of your password;

  • Restricting access to your account and devices;

  • Ensuring that your account information remains accurate; and

  • Notifying us promptly of suspected unauthorized access.

You are responsible for activity conducted through your account unless prohibited by applicable law.

6. Payment Processing

Payments may be processed by third-party payment processors. By submitting payment information, you authorize Eeshas.com and its payment-service providers to charge the applicable amount to your selected payment method.

We do not guarantee that every payment method will be available for every transaction, customer or location.

We may use fraud-prevention and payment-verification services. An order may be delayed, placed on hold or canceled if additional verification is required or if the transaction is identified as potentially unauthorized or fraudulent.

7. Shipping and Delivery

Shipping methods, estimated processing times and estimated delivery timeframes are provided during checkout or in our Shipping Policy.

Delivery dates are estimates unless expressly guaranteed in writing. Delivery may be affected by carrier delays, weather, customs processing, incorrect addresses, holidays, supply disruptions or other circumstances beyond our reasonable control.

When we are unable to ship within the timeframe originally represented, we will provide any notice, cancellation opportunity or refund required by applicable law.

Risk of loss and title to purchased products pass as provided under applicable law and the terms of the shipping carrier. Where permitted, delivery may be considered complete when the carrier records the package as delivered to the address supplied by the customer.

Customers should promptly inspect delivered packages and notify us of missing, damaged or incorrect items in accordance with our Shipping Policy and Return and Refund Policy.

8. Returns, Exchanges and Refunds

Returns, exchanges, cancellations and refunds are governed by our separate Return and Refund Policy, which is incorporated into these Terms and Conditions by reference.

Products must satisfy the conditions and deadlines stated in that policy. Unless otherwise required by law, certain products may be final sale or ineligible for return, including:

  • Customized, personalized, altered or made-to-order products;

  • Sarees or garments that have been worn, washed, ironed, damaged or altered;

  • Products with removed tags, damaged packaging or signs of use;

  • Clearance or final-sale merchandise;

  • Gift cards; and

  • Items identified as nonreturnable in the product description.

Return shipping charges, original shipping charges and restocking fees, if any, will be handled as stated in our Return and Refund Policy.

Nothing in these Terms limits any nonwaivable consumer right available under applicable law.

9. Preorders, Made-to-Order and Customized Products

Certain products may be offered as preorders, made-to-order items or customized products.

Estimated completion and shipping dates for such products are projections and may change because of artisan production schedules, fabric availability, supplier delays, quality inspections or other production-related circumstances. If the ordered product becomes unavailable due to any of these circumstances, Eeshas.com may offer the customer one or more similar or comparable product options for consideration. The customer may choose an alternative product or request another available remedy in accordance with our Return and Refund Policy.  

Customized or made-to-order items may not be canceled after production begins and may be ineligible for return or exchange, except when required by law or when the product arrives materially different from the confirmed order.

Customers are responsible for reviewing and approving all submitted measurements, colors, design selections, spelling and customization instructions before production begins.

10. Product Care and Use

Customers must follow the care instructions provided with the product or displayed on the product page.

Certain sarees and garments may require dry cleaning, gentle handling, separate storage or protection from moisture, perfumes, chemicals, direct sunlight or abrasive surfaces.

Eeshas.com is not responsible for damage caused by improper washing, ironing, storage, alteration, handling, jewelry snagging, chemical exposure or failure to follow the recommended care instructions.

11. Promotions, Coupons and Gift Cards

Promotional offers, discount codes, coupons and gift cards are subject to the conditions stated with the applicable offer.

Unless otherwise stated:

  • Promotional codes cannot be combined;

  • Discounts do not apply retroactively;

  • Offers have no cash value;

  • Promotions may exclude certain products or collections;

  • Promotions may be limited by customer, household, account or order; and

  • We may modify or end a promotion before its scheduled end date when permitted by law.

We may cancel or refuse a promotion that was obtained or used through fraud, manipulation, technical error or violation of the stated promotional conditions.

12. Intellectual Property

All content appearing on Eeshas.com—including our business name, trademarks, logos, slogans, product names, original garment concepts, saree-wearing designs, photographs, videos, graphics, illustrations, website design, written descriptions, text and other materials—is owned by or licensed to Eeshas.com and is protected by applicable intellectual-property laws.

You may access and use the website only for personal, noncommercial shopping purposes.

Without our prior written permission, you may not:

  • Copy, reproduce, modify, distribute, republish or commercially exploit website content;

  • Use our photographs, product descriptions, videos or graphics on another website, marketplace or social-media account;

  • Manufacture, reproduce or commercially market products based on proprietary Eeshas.com designs;

  • Remove copyright, trademark or proprietary notices;

  • Use automated systems to scrape or extract website content;

  • Create derivative works from our proprietary content; or

  • Use the Eeshas.com name, logo or branding in a manner that suggests sponsorship, authorization or affiliation.

No license or ownership interest is transferred to you by your use of the website or purchase of a product.

You may be permitted to submit reviews, comments, photographs, testimonials, questions or other content.

You represent that your submission:

  • Is accurate and based on your genuine experience;

  • Does not contain malware, spam or unauthorized advertising; and

You retain ownership of content you create. However, by submitting content to Eeshas.com, you grant us a nonexclusive, worldwide, royalty-free, transferable and sublicensable license to use, reproduce, edit, display, publish and distribute the content for operating, improving and promoting our business, subject to applicable law.

We may moderate, reject or remove submitted content, but we are not obligated to monitor every submission.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Eeshas.com and its owners, officers, employees, affiliates, contractors, suppliers and service providers will not be liable for indirect, incidental, special, punitive, exemplary or consequential damages arising from or related to:

To the extent liability cannot legally be excluded, the total liability of Eeshas.com arising from a particular order will not exceed the amount paid to Eeshas.com for the product giving rise to the claim.

These limitations do not exclude liability that cannot legally be limited or excluded, including liability arising from intentional misconduct or other nonwaivable legal obligations.

To the extent permitted by law, you agree to indemnify, defend and hold harmless Eeshas.com and its owners, officers, employees, affiliates, contractors and service providers from third-party claims, liabilities, damages, losses and reasonable legal expenses arising from:

This section does not require you to indemnify Eeshas.com for claims caused solely by Eeshas.com’s own unlawful conduct.

Eeshas.com will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fires, floods, pandemics, labor disruptions, transportation interruptions, government actions, customs delays, power failures, internet outages, cyber incidents, carrier disruptions, supplier shortages or civil disturbances.

We will make reasonable efforts to communicate material delays and provide remedies required by applicable law.

22. Suspension and Termination

These Terms and Conditions remain effective while you use Eeshas.com.

You may stop using the website at any time. We may suspend or terminate your access when we reasonably believe that you have violated these Terms and Conditions, engaged in fraudulent activity or created a security or legal risk.

Provisions concerning payments, intellectual property, disclaimers, limitations of liability, indemnification and dispute resolution will survive termination where appropriate.

23. Governing Law and Dispute Resolution

These Terms and Conditions and any dispute relating to Eeshas.com will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Before initiating formal legal proceedings, you and Eeshas.com agree to make a good-faith effort to resolve the dispute by contacting the other party and providing a reasonable description of the issue and requested resolution.

Unless applicable law requires otherwise, legal proceedings relating to these Terms and Conditions must be brought in a state or federal court with jurisdiction over the county in Texas where Eeshas.com maintains its principal place of business.

Nothing in this section prevents either party from seeking relief in small-claims court when the claim qualifies, or from seeking emergency injunctive relief to protect intellectual-property or confidential-information rights.

Customers may also have nonwaivable rights under the laws of the state or country where they reside.

24. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed if necessary.

The remaining provisions will remain valid and enforceable.

25. No Waiver

Our failure to enforce a provision of these Terms and Conditions does not waive our right to enforce that provision or any other provision in the future.

A waiver is effective only when made in writing by an authorized representative of Eeshas.com.

26. Assignment

You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, business reorganization, sale of assets or transfer to an affiliated company, subject to applicable law.

These Terms and Conditions, together with our Privacy Policy, Shipping Policy, Return and Refund Policy and any other policies displayed on Eeshas.com, constitute the entire agreement between you and Eeshas.com concerning your use of the website and purchase of products.

If a product-specific term conflicts with these general Terms and Conditions, the product-specific term will control for that product.

We may update these Terms and Conditions periodically to reflect changes in our business, website, services or legal obligations.

The revised version will be posted on this page with an updated “Last Updated” date. Changes become effective when posted unless a later effective date is stated.

Material changes will not retroactively reduce rights relating to an order that was completed before the change, except where required by law.
